Abstract

Ecclesiastic privileges were a legacy from the Indiano law to the national law, although, from the beginning of the republican life, its abolition was expected. The opportunity to do that was given by the analysis of the law governing both the organization and attribution of courts, passed in 1875. The development of the arguments is studied from the special perspective of the intervention made by the Chilean bishops and the Holy See, to which these bishops and the government of Chile went. The privileges were revoked because they were abolished along with the resource to force, a solution with which each party was satisfied.
