Statu quo of the simulation of the marriage. Before and after of the New Civil Marriage Act

Abstract

In this article we will study the absence of an explicit regulation of the simulation on the subject of civil marriage. After a brief reference to the state of the matter in Canon Law, we analyze the discipline given to the subject by the CC and by the LMC of 1884. We will then study the discussions regarding the simulation that emerged during the course of the project of Law that would become Law Nº. 19,947, to ἀnally refer to the absence of an express treatment of the simulation in the NLMC, the above does not preclude its punishment with the non-existence.
