The projection of the treatise on stipulations from sabin’s libri tres iuris civilis in julian’s digesta, gayo’s institutions and corpus iuris
Abstract
This study is about the structure or system of the expositions about conventional stipulatio in several works of the Roman jurisprudence. It is suggested that the treatise on the topic appearing in Sabin's iuris civilis libre tres was the base, and that in the matter the works of the type digesta, quaestiones, responsa, sententiae and similar depend on it that, since Cels, the classic jurists started writing, such as Gayo's institutiones (and after that, Justinian's). The structure offered by the topic in the codex Iustinianus and in the Iustiniani digesta is also examined.
