Historia del derecho y ciencia jurídica en los estados unidos de américa: el debate en torno al historicismo crítico de robert w. gordon
Abstract
The discussion about the debate that must arise between Legal History and Legal Scholarship has been a permanent question in the development of thinking of American jurist. Professor Robert W. Gordon´s so-called "Critical Historicism" is one of the most stimulating and exciting approaches to this question in the last decades. "Critical Historicism" represents the start for a new historical viewpoint for jurists. The object of the present study is to do some research on this new current of thinking inaugurated by Gordon and to reconstruct the present controversy between its defenders and its detractors. Also, this paper offers a reflection on the American Legal Historiography because this is the context in which this debate can be understood.
