La sistemática del derecho privado en el de iure belli ac pacis de hugo grotius
Abstract
This article contains a summary of the thinking emerging from the juridical movement of humanism or mos Gallicus -oriented toward making a new order of the juridical matters that might go beyond the old ordo legalis contained in the Justinian compilations in light of the Ciceronian ideal of the ius in artem redigere, in several cases under the modern guidance of Pierre de la Ramee's (Ramus) dialectics. Hugo Grotius showed himself deeply interested in a humanistic mark, and he expressed the above in various places. The general order or system employed in De iure belli ac pacis¸ particularly applied to private law dealt with in Book II of that work, is discussed. The possibility that Grotius might have formed his system of private law under Ramee's formal influences is analyzed. Grotius' material sources of the private system are looked at, and it is concluded that they are largely scholastic, although some of humanistic jurist Hugo Donellus' standpoints influenced them.
